These Terms of Service (“Terms”) form a binding agreement between Truss Studios Pvt. Ltd. (“Truss,” “we,” “us”) and the parent or legal guardian (“you,” “Parent”) who creates a Neev account on behalf of a child. By powering on the Neev device, signing up to the parental dashboard, or using any part of the Neev service, you confirm that you have read and accepted these Terms.
1. Acceptable use
- Parent supervision. Neev is intended for ages 4–12 and must be operated under the supervision of the Parent. The Parent is responsible for configuring age band, quiet hours, persona allow-list, and reviewing transcripts in the parental dashboard.
- No harmful prompting. You agree not to deliberately try to elicit unsafe, sexual, self-harm, violent, or illegal content from Neev, and not to bypass or attempt to bypass our safety filters.
- No misuse. You will not resell, sublicense, reverse-engineer the firmware, scrape the service, or use Neev to infringe any third-party rights.
- One household. An account is licensed for use by a single family household. Commercial, classroom, clinical, or institutional use requires a separate written agreement.
2. License to use the device and service
Subject to your compliance with these Terms, Truss grants you a personal, non-exclusive, non-transferable, revocable license to (a) use the Neev hardware device you have purchased, (b) install and use the companion firmware and any over-the-air firmware updates we issue, and (c) access the cloud service (assistant, persona library, parental dashboard) for the lifetime of your active subscription or, for one-time-purchase devices, for the support period stated on the product page.
All intellectual property in the device, firmware, software, personas, voice models, and documentation remains with Truss Studios or its licensors. No source code, training data, or model weights are licensed to you.
3. Warranty disclaimers
The Neev service is provided “as is” and “as available.” To the maximum extent permitted by law, Truss disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that safety filtering will block every undesirable response in every context.
Neev is not a substitute for parental judgement, qualified medical advice, mental- health treatment, special-education services, or emergency response. If a child is in distress, call your local emergency number (112 in India) or a qualified professional. Hardware enjoys the manufacturer’s limited 12-month warranty against defects in materials and workmanship under normal household use.
4. Limitation of liability
To the maximum extent permitted by Indian law, Truss Studios’ total aggregate liability arising out of or relating to the Neev service in any 12-month period will not exceed the greater of (a) the amount you paid us for the device and subscription in that period, or (b) ₹10,000. Truss will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of goodwill, or emotional distress.
Nothing in these Terms limits liability for (i) death or personal injury caused by negligence, (ii) fraud, or (iii) any liability that cannot be excluded under Indian law.
5. Parent-account responsibilities
- Keep your account credentials confidential; you are responsible for activity under your account.
- Provide accurate child age-band and language settings so safety filters operate correctly.
- Review the parental dashboard at least weekly; act promptly on safety alerts.
- Notify us at hello@truss.biz if you suspect unauthorised account access.
- Ensure the device is used in a safe physical environment (secure power supply, no choking-hazard placement for small children, supervised charging).
6. Account suspension and termination
We may suspend or terminate an account if:
- You materially breach these Terms or the Privacy Policy.
- We are required to do so by law or valid order of an Indian court.
- Repeated attempts are made to bypass safety filters or extract restricted content.
- The account is used commercially without our written consent.
You may terminate your account at any time from Settings → Account → Delete account. Termination triggers deletion of all stored child data within 30 days (see Privacy Policy, Section 3). Sections that by their nature should survive termination (intellectual property, liability limits, dispute resolution) will continue to apply.
7. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of India. Subject to Section 8 below, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Neev service.
8. Dispute resolution
Before initiating court proceedings, the parties shall attempt in good faith to resolve any dispute through written notice and 30 days of negotiation. If unresolved, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement (or, failing agreement, by the Bangalore International Arbitration Centre). The seat of arbitration shall be Bengaluru and proceedings shall be in English. The award shall be final and binding.
Nothing in this section prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
